Win A Chevy, Fuel A School Official Raffle Rules
The Jimmie Johnson Foundation (the “Foundation”), a Michigan non-profit corporation, a tax-exempt organization under Section 501(c)(3) of the Internal Revenue Code, has partnered with The Eleven Group, LLC – The Charity Splits Company (“Charity Splits”) to conduct the Win A Chevy, Fuel A School Raffle (“Raffle”). By purchasing a Raffle ticket (a “Ticket”) the entrant agrees to be bound by these rules and regulations. The Raffle to benefit the Foundation is offered only in the United States and is open only to legal residents of the United States, 18 years of age or older at the time of entry. The Raffle begins on February 13, 2012 and ends on September 6, 2012, or when all Tickets are sold, whichever comes first (the “Entry Deadline”). The Raffle is subject to all applicable federal, state, and local laws and regulations, and is void wherever prohibited or restricted by law. An affidavit of eligibility may be required from the prize winner. Employees, as well as their immediate family members (parents, children, siblings, spouse) and others living in their same household, whether related or not, of the Foundation, Jimmie Johnson II Racing Inc., Alan R. Miller P.C., Charity Splits, and their affiliates are not eligible to enter.
How to enter: To enter the Raffle, please register online at www.fuelaschool.org (the “Website”), a secure online purchase site owned and managed by Charity Splits. To enter, an entrant must purchase a Raffle ticket (“Ticket”) through the Website. Charity Splits accepts Visa, Master Card and Discover or AmEx as payment. All payments are made to Charity Splits. Raffle tickets are not tax-deductible contributions to the Jimmie Johnson Foundation. Credit card payments are processed immediately and Ticket(s) is/are issued following credit card approval. Credit cards that are denied shall disqualify the Ticket. Payment must be made in U.S. Dollars. Entries must be received prior to the Entry Deadline. Entries will only be accepted via the Website and will not be accepted by mail or any other means. Refunds will only be granted at the exclusive discretion of Charity Splits and if a Ticket order is placed and payment is received after the Entry Deadline. Winner will be drawn on or before September 7, 2012 (the “Drawing”). Charity Splits assumes no responsibility for any failure to receive orders or deliver receipts prior to the Entry Deadline. Only one eligible entrant may be entered in the Raffle per Ticket sold. If the name of more than one person is submitted with a Ticket purchase, and that Ticket is selected during the Drawing, the person named first on the Ticket will be deemed the entrant and holder of record of that Ticket and declared the winner. A Ticket will be void and a prize not paid/redeemed if the Ticket was stolen, non-issued, ineligible, altered counterfeit in whole or in part, defective, printed in duplicate, printed/produced in error or otherwise deemed ineligible. It shall be the sole responsibility of the entrant to verify the accuracy and condition of the data printed on the Ticket at the time of purchase. All electronic entries become the sole property of Charity Splits and will not be returned. A winner's list may be obtained by sending a self-addressed stamped envelope to the following address after September 7, 2012: Charity Splits, Win A Chevy, Fuel A School Raffle, 116 Chicago Street, Suite 304, Joliet, IL 60432. Entries will be certified and the winner will be drawn at random under the supervision of an independent raffle auditor. The winner of the Raffle will be notified by email as specified in this Agreement. The winner need not be present to win.
Grand Prize/Odds of Winning: The winner of the Raffle may choose one (1) of the following vehicles: (1) a 2013 Chevy Camaro, (2) a 2013 Chevy Corvette, (3) a 2013 Chevy Silverado, or (4) a 2013 Chevy Tahoe. Winner must claim prize within fourteen (14) business days of the Drawing or a new winner will be selected. Winner may select model, features and upgrades of the selected vehicle, including but not limited to interior color, exterior color, hybrid option, stereo, trim, and wheels, subject to availability and the approval of both the Foundation and manufacturer. Vehicle options are limited to those available from the manufacturer and available to the vehicle selected. The following models are not eligible to be selected: Camaro ZL1, Corvette ZR.1, Corvette Z06. The final total retail value of the vehicle (“Total Retail Value”) including, but not limited to the chosen model, features and upgrades shall not exceed a Seventy Five Thousand ($75,000) Dollar total retail value for the vehicle (“Maximum Possible Retail Value”). If vehicle options and upgrades result in a Total Retail Value that is less than the Maximum Possible Retail Value, winner will not be compensated for the difference between the Total Retail Value and the Maximum Possible Retail Value. If vehicle options and upgrades result in a Total Retail Value that is more than the Maximum Possible Retail Value, the winner agrees to pay the additional costs. Once the prize is claimed, winner will have seven (7) business days to select the vehicle, vehicle features and vehicle upgrades. Vehicle will be delivered approximately 8-12 weeks from receipt of final order, pending unforeseen circumstances. Winner must take delivery of vehicle from the dealership designated by the Foundation within thirty (30) business days of vehicle delivery or forfeits all claims thereto. The Foundation will make every effort to consider the dealership geographically near the Winner. Winner must provide valid driver's license and evidence of legally required automobile insurance at time of delivery. Winner is responsible for all fees associated with the prize, including but not limited to title fees, licensing fees, registration fees, dealer costs, sales tax, and automobile insurance. Notwithstanding the foregoing, the Foundation will pay taxes related to the prize up to 28% of the total retail value up to $75,000; provided, however, in no event will the Foundation tax contribution for the prize exceed the amount of taxes related to the prize. In order to receive the tax contribution, Winner must provide the Foundation with a copy of their prior year IRS tax return Form 1040 within seven (7) business days of prize notification. If such documentation is not provided, Winner will not be eligible for the tax contribution. Other than the Foundation’s tax contribution, the Foundation and Charity Splits and all contractually associated parties have no responsibility for the payment of any taxes or fees associated with the prize. Please consult your tax advisor with any questions. If an entrant is unable to pay the taxes, fees and like charges associated with the prize at the time the prize is awarded, after the credit of the Foundation’s tax contribution, then that entrant will be automatically disqualified and an alternate winner will be drawn. The maximum fair market value of the prize is estimated at an amount no more than Seventy-five Thousand ($75,000) Dollars. Winner and a guest will also be invited to attend Foundation Fest in Charlotte, North Carolina on Thursday, October 11, 2012 and to attend the Bank of America 500 at Charlotte Motor Speedway on Saturday, October 13, 2012. Jimmie Johnson’s presence at Foundation Fest is subject to his racing schedule. No prize substitution or cash equivalent of prize except at the sole discretion of Charity Splits and the Foundation. No prize transfer shall be permitted. A maximum of three thousand (3,000) Tickets will be sold. Odds of winning are determined by the total number of entries received, with the maximum odds of 1:3,000.
General Conditions: By entering, entrants accept and agree to these Official Rules and the decisions of Charity Splits and the Foundation, which are final and binding in all respects. Winner will be notified by email. Charity Splits will use the e-mail address given at the time of purchase by the entrant. It is the entrant’s sole responsibility to confirm ticket information and purchase. Charity Splits and the Foundation are not responsible for incorrect e-mail addresses. In order to be deemed a valid winning Ticket, all of the following conditions must be met: (1) The validation data must be present in its entirety and must correspond, using the computer validation file, to the number selections printed on the Ticket for the drawing date(s) and, if applicable, drawing time, printed on the Ticket, (2) The Ticket must be sufficiently intact to permit validation; (3) The Ticket must not be intentionally mutilated, altered, reconstituted, or tampered with in any manner; (4) The Ticket must not be counterfeit or an exact duplicate of another winning Ticket; (5) The Ticket must have been issued by an authorized Charity Splits official Ticket supplier; and (6) The Ticket must not have been stolen or canceled. A Ticket submitted for validation which fails any of the preceding validation conditions shall be considered void.
In order to collect the prize, winner must sign and deliver to Charity Splits within fourteen (14) business days of notification (1) a sworn affidavit of eligibility in accordance with these Rules and applicable law; (2) such written information as required by any applicable tax including Social Security Number; (3) proof of identity in forms satisfactory to Charity Splits; (4) a liability release and a publicity release, where legal; and (5) the winning Ticket receipt. Winner may be required to submit a W-2G, Form 5754, Form 1040 or similar tax form (provided by The Foundation) for tax withholding purposes. In the event of non-compliance with requirements, or if prize notification is returned as undeliverable, prize will be forfeited and an alternate winner selected. By accepting the prize, except where prohibited by law, winner agrees to the use of his or her name and/or photograph for advertising/publicity purposes without further compensation or notice. By participating, entrant agrees to release and hold harmless the Foundation, Jimmie Johnson II Racing, Inc., Alan R. Miller P.C., and Charity Splits and their respective parents, affiliates and subsidiaries, and the directors, officers, agents and employees of any such entity (collectively, the "Released Parties") from any and all liability arising from participating in the Raffle and/or acceptance, possession or use/misuse of prize, regardless of whether such claims are founded in whole or part upon alleged negligence, gross negligence or willful misconduct of any of the Released Parties. Charity Splits reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Raffle; to be in violation of the Official Rules, or to be acting in a disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person. Any activities intended to disrupt or interfere with the proper play of the Raffle or defraud Charity Splits in any way will be prosecuted to the fullest extent of the law. The Raffle is subject to all applicable laws of the United States. Limitations of Liability: Charity Splits is not responsible for any incorrect or inaccurate information, including, without limitation, which is caused by web site users, tampering, hacking, or by any of the equipment or programming associated with or utilized in the Raffle or by any technical or human error which may occur in the processing of entries in the Raffle. Charity Splits assumes no responsibilities for any error, omission, interruption, deletion, or defection, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of web site or entries in processing the Raffle entries. Charity Splits is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, failure of email or entrants on accounts of technical problems or traffic congestion on the Internet or at any web site associated with the Raffle. Charity Splits is not responsible for user cheating or fraud by any entrants. If, for any reason, the Raffle cannot run as planned, including, without limitation, unauthorized intervention, fraud, technical failures or any other causes beyond the control of Charity Splits which, in Charity Split’s sole discretion could corrupt or affect the administration, security, fairness, integrity or proper conduct of the Raffle, Charity Splits, in its sole discretion, may cancel the Raffle and return/refund all entries or select the winner in a random drawing comprised of all eligible entries received prior to (and/or after, if appropriate) the action taken by Charity Splits. Charity Splits and the Foundation reserve the right at their sole discretion to cancel, terminate, modify or suspend the Raffle.
